How to get a criminal record check/ police clearance certificate in Vietnam?

I. What is a Criminal Record Check?
According to Article 2 of the Law on Judicial Records No. 28/2009/QH12 dated 17 June 2009, the Police Record Check is a document issued by the competent agency (the provincial Justice Department or the National Center for Police Records) to prove whether or not an individual has the previous criminal conviction, is banned to establish, manage enterprises in case the companies is declared bankrupt by Court.
There are two types of Police Clearance Certificate: Police Clearance Certificate No. 1 and Police Clearance Certificate No. 2.
- The Police Clearance Certificate No. 1 includes criminal conviction which is not removed, no records about the criminal conviction which is expunged, and information relating to the banning in establishing, and managing the enterprise per request.
- However, the Police Clearance Certificate No.2 includes much more information, including all criminal convictions that are removed and are not expunged and information relating to the banning of establishing, and managing the enterprise
For the foreigners submitting a Work permit in Vietnam, the Criminal Record Check No. 1 is required, and this certificate should obtain within 6 months from the days in which the application for a work permit is submitted to the Department of Labor.
II. Steps to obtain the Police Record Check in Viet Nam
2.1 Case 1: Criminal Record Check for
a/ Vietnamese citizens permanently or temporarily residing in Vietnam;
b/ Vietnamese citizens currently residing overseas;
c/ Foreigners currently residing in Vietnam (Criminal Record Check for a work permit in Viet Nam)
2.1.1 Step 1: Preparation of the Dossier for Police Record Check in Viet Nam
- The Application Forms (Form No.3/2013/TT-LLTP);
- The certified copy of the passport with all pages (for foreigners) or the certified copy of ID card or passport or citizen identification (for the Vietnamese)
- The certified copy of the temporary residence confirmed by the ward-level police (for foreigners);
- The certified copy of the family record book or the certified copy of the temporary resident book (for Vietnamese)
2.1.2 Step 2: Submit the Application: the applicant can choose to submit in person or online

The applicant can register the address on the website and the postman will come to the address to pick up all the original documents and hand over the results. |

2.2 Case 2: Criminal Record Check for:
a/ Vietnamese citizens whose places of permanent or temporary residence are unidentifiable;
b/ Foreigners who resided in Vietnam.
2.2.1. Step 1: Preparation of the Dossier:
- The Application Forms (Form No.3/2013/TT-LLTP);
- The certified copy of the passport with all pages (for the foreigners);
- The certified copy of ID card or passport or citizen identification (for the Vietnamese);
2.2.2 Step 2: Submit the Application: the applicant can choose to submit in person or online.
