November 8, 2024 | Q&A, Work Pemit in Vietnam

Dear DB Legal - Labor Law Firm in Da Nang, Our foreign company's branch in Vietnam has a number of foreign employees who are sent to work. Thus, do these foreign workers have to pay health insurance? Thank you.

Answer:

Thank you for contacting DB Legal with your inquiry regarding health insurance obligations for foreign workers at your branch in Vietnam.

We understand that navigating Vietnamese labor law can be complex, and we're here to provide clarity on this matter.

In general, foreign employees working in Vietnam are required to participate in the national health insurance scheme if they meet the following criteria:

- Valid Work Permit: They possess a valid work permit issued by a competent Vietnamese authority. (Please note that certain exemptions may apply, such as for individuals with diplomatic status or those covered by specific international agreements.)

- Labor Contract Duration: They have entered into a labor contract with a duration of at least three months, whether it's a fixed-term or indefinite-term contract.

Contribution Rates: The health insurance contribution is calculated as 4.5% of the employee's monthly salary used for social insurance calculations. This is shared between the employer (3%) and the employee (1.5%).

Key Legislation:

The legal framework for health insurance in Vietnam is primarily found in:

- Consolidated Document No. 28/VBHN-VPQH dated December 7, 2020, of the National Assembly Office issuing the Law on Health Insurance

- Decree No. 143/2018/ND-CP detailing a number of articles of the Law on Social Insurance and the Law on Occupational Safety and Hygiene.

If you require further clarification or assistance in assessing specific cases or navigating potential exemptions, please don't hesitate to contact us. We are committed to providing you with the legal support you need to ensure your operations in Vietnam remain compliant and efficient.
