Regulations Governing Foreign Investors Engaging in Commercial Arbitration and Mediation Services in Vietnam

Foreign investors' participation in the provision of commercial arbitration and commercial mediation services in Vietnam is governed by both international commitments and domestic legislation. The trade agreements to which Vietnam is a party establish certain principles and limitations regarding market access, while Vietnamese law specifically prescribes the conditions and forms of operation applicable to organizations providing these services. The interplay between these legal frameworks necessitates a systematic examination of the relationship between market-opening obligations and domestic investment regulatory mechanisms. Therefore, studying the regulations governing foreign investors engaging in commercial arbitration and commercial mediation services in Vietnam is of practical significance in clarifying the scope of market access and the legal requirements that must be satisfied when conducting such activities.

Properly identifying the scope of market access commitments, applicable reservations, and operational requirements for each type of organization is essential to ensuring the legality of investment activities. Accordingly, continued review and improvement of the legal framework, together with efforts to ensure consistency among relevant legal provisions, will help enhance transparency, facilitate foreign investment, and strengthen the effectiveness of state management in this specialized service sector.
