2. What is the Civil Litigation in Vietnam?

Litigation means the action taken by one party against another party to enforce or defend their rights under the law to the Court. Litigation is a common method for resolving disputes in Vietnam, particularly when parties have not agreed to choose alternative dispute resolution methods such as arbitration or mediation. The parties may take their case to Court and have the Judge or jury decide who "wins" and who "fails."

The Civil Procedure Code in Vietnam applies to the settlement of civil cases involving foreign element(s); where the international treaties to which the Socialist Republic of Vietnam is a signatory provide otherwise, the provisions of such international treaties shall apply.
