Conditions for marriage involving foreign nationals under Vietnam’s 2026 Law on Civil Status
Marriage involving a foreign national in Vietnam requires the parties to satisfy the applicable legal conditions and to comply with the civil status registration requirements. Vietnam’s Law on Civil Status No. 03/2026/QH16, effective from 1 March 2027, provides a new framework for the registration of marriages involving foreign elements. While the Law on Civil Status governs the registration procedure and the competent authority, the substantive conditions for marriage must also be considered under Vietnam’s Law on Marriage and Family and the applicable foreign law.

1. Age and Voluntary Consent
Under Article 8 of Vietnam’s Law on Marriage and Family 2014, a marriage must satisfy the following conditions:
- The man must be at least 20 years old and the woman at least 18 years old;
- The marriage must be entered into voluntarily by both parties;
- Neither party may have lost their civil act capacity; and
- The marriage must not fall within a prohibited category under Vietnamese law.
The parties must make their own decision to marry. A marriage involving coercion, deception or a sham arrangement may violate Vietnamese law. These substantive conditions remain relevant when a marriage is registered under the new civil status framework. The registration authority’s jurisdiction under the 2026 Law does not replace the legal requirements governing whether the parties may marry.
2. Existing Marital Status and Prohibited Marriages
A person who is currently married may not enter into another marriage in violation of Vietnamese law. Before applying for marriage registration, the parties should confirm that any previous marriage has been legally terminated. Where a foreign national was previously married abroad, documents relating to divorce or the dissolution of the former marriage may be relevant to establishing the person’s current marital status. Vietnamese law also prohibits marriage between persons within certain family relationships, including direct-line relatives and other relationships specified by law. The parties should therefore review their marital status and family relationship before preparing the registration application.
3. Conditions Applicable to Foreign Nationals
For a marriage involving a foreign national, the applicable legal framework includes Vietnamese law and, where relevant, the law of the foreign national’s country of citizenship. Article 126 of the Law on Marriage and Family 2014 provides that a foreign national marrying a Vietnamese citizen before a competent Vietnamese authority must satisfy the marriage conditions under Vietnamese law. The foreign national must also comply with the conditions for marriage under the law of their country of citizenship, subject to the relevant Vietnamese legal provisions. This means that satisfying the Vietnamese age and consent requirements alone may not be sufficient. The parties should also verify whether the foreign national’s law imposes additional conditions or requires particular documents to demonstrate eligibility to marry.
4. The Registration Case Must Fall Within Article 16 of the 2026 Law
Article 16 of Law No. 03/2026/QH16 identifies the marriage cases registered by commune-level People’s Committees, including marriages between Vietnamese citizens residing in Vietnam and foreign nationals. The provision also covers certain marriages involving Vietnamese citizens residing abroad and persons of Vietnamese origin whose nationality has not been determined, in the circumstances specified by the Law. The parties should confirm that their circumstances fall within the relevant category under Article 16 before applying. The competent authority and applicable procedure should be determined by reference to the parties’ nationality and residence status, rather than solely by the fact that one party is a foreign national.
5. Legal Capacity and the Absence of Prohibited Circumstances
The parties must have the legal capacity required to enter into marriage. Under Vietnamese law, a person who has lost their civil act capacity cannot marry. The marriage must also be free from prohibited circumstances, including:
- A sham marriage intended to obtain immigration, residence or other benefits without establishing a genuine marital relationship;
- Coercion or deception in marriage;
- A marriage entered into while one party is already married in violation of the law; and
- Marriage between persons whose family relationship falls within a legally prohibited category.
The registration procedure under the 2026 Law does not remove the need to satisfy these substantive conditions.
6. Documents and Evidence Relevant to the Conditions
The documents required to demonstrate eligibility to marry depend on the parties’ circumstances and the administrative procedure applicable when the application is submitted. Relevant documents may include:
- Identity documents and passports;
- Evidence of current marital status;
- Documents confirming the termination of a previous marriage, if applicable;
- Documents required under the foreign national’s applicable law; and
- Medical or other supporting documents where required by the applicable procedure.
Foreign documents may be subject to consular legalisation and Vietnamese translation requirements, unless an exemption applies under Vietnamese law or an applicable treaty. Applicants should verify the current administrative requirements rather than assume that a document issued overseas will automatically be accepted by the Vietnamese registration authority.
7. Effective Date of the 2026 Law
Law No. 03/2026/QH16 takes effect on 1 March 2027. The new provisions governing the registration of marriages involving foreign elements should therefore be applied from that date. For applications received before the Law takes effect but not yet resolved, the applicable transitional provisions must be considered. Parties planning to register their marriage around the effective date should confirm the relevant legal framework before submitting their application.
8. Conclusion
Marriage involving foreign nationals in Vietnam requires the parties to satisfy the substantive conditions for marriage under Vietnamese law and the applicable foreign law. These conditions include legal age, voluntary consent, legal capacity, current marital status and the absence of prohibited family relationships or other prohibited circumstances. The 2026 Law on Civil Status establishes the registration framework and identifies the competent authority for the relevant cases. A careful review of both the marriage conditions and the applicable registration procedure can help the parties prepare appropriate supporting documents and avoid delays.
