Prohibited Acts in Civil Judgment Enforcement in Vietnam

1. Agencies, organizations, and individuals are strictly prohibited from committing the following acts:

a) Failing to comply with judgments or rulings; failing to comply with decisions and requests of civil judgment enforcement agencies, Enforcement Officers, civil judgment enforcement offices, or Bailiffs; resisting, delaying, or committing acts that cause difficulties or obstruct the enforcement organization process;

b) Taking bribes; misappropriating or unlawfully using exhibits, money, or judgment enforcement assets; breaking seals, consuming, swapping, concealing, destroying, or dispersing exhibits or seized assets; altering the current status, or transferring the ownership or use rights of judgment enforcement assets;

c) Intentionally failing to issue judgment enforcement decisions or issuing judgment enforcement decisions contrary to the law; unlawfully applying enforcement coercion measures;

d) Taking advantage of or abusing positions and powers to unlawfully obstruct or interfere with the handling of judgment enforcement, or exploiting personal influence to exert pressure on persons responsible for judgment enforcement; intentionally enforcing contrary to the content of judgments or rulings; taking advantage of or abusing positions and powers to carry out unlawful enforcement or delay judgment enforcement;

đ) Forging or falsifying documents, files, records, information, or electronic data to evade judgment enforcement obligations or prolong the enforcement organization timeframe; disclosing information, or taking advantage of/abusing information regarding accounts, income, and assets of judgment debtors to use unlawfully or prejudice judgment enforcement;

e) Infringing upon or threatening to infringe upon the security, safety, and public order of the headquarters of judgment enforcement agencies and venues where judgment enforcement activities take place;

g) Filing complaints, denunciations, reports, or disseminating information known to be untruthful to incite, falsely accuse, defame, or insult the prestige, solemnity, honor, and dignity of agencies, organizations, or public duty performers in judgment enforcement activities;

h) Displaying irresponsibility or intentional delay in leading, directing, and organizing security and protection measures for agencies, organizations, and public duty performers in judgment enforcement activities;

i) Infringing upon the life, health, prestige, honor, dignity, or property of Enforcement Officers, Bailiffs, other participants in judgment enforcement activities, or their relatives;

k) Evading the payment of judgment enforcement fees or other mandatory amounts.

2. Enforcement Officers are strictly prohibited from committing the following acts:

a) Acts specified in Points b, c, d, and đ, Clause 1 of this Article;

b) Acts that civil servants are prohibited from doing under the provisions of law;

c) Violating professional code of ethics for Enforcement Officers;

d) Directly organizing the enforcement of judgments involving the rights and interests of themselves and their spouse, biological children, adopted children; biological parents, adoptive parents, paternal grandparents, maternal grandparents, uncles, aunts, and biological siblings of the Enforcement Officer, or of the spouse of the Enforcement Officer; or biological nieces and nephews for whom the Enforcement Officer is a grandparent, uncle, or aunt.

3. Bailiffs / Private Enforcement Officers are strictly prohibited from committing the following acts:

a) Acts specified in Points b, d, and đ, Clause 1 of this Article;

b) Violating professional code of ethics for Bailiffs;

c) Taking advantage of or abusing assigned tasks and powers, or using provided information to threaten, harass, or commit other unlawful acts against agencies, organizations, or individuals during the enforcement organization process;

d) Directly organizing the enforcement of judgments involving the rights and interests of themselves and their spouse, biological children, adopted children; biological parents, adoptive parents, paternal grandparents, maternal grandparents, uncles, aunts, and biological siblings of the Bailiff, or of the spouse of the Bailiff; or biological nieces and nephews for whom the Bailiff is a grandparent, uncle, or aunt;

đ) Concurrently practicing at two or more civil judgment enforcement offices; concurrently acting as a lawyer, notary public, asset administrator/insolvency practitioner, auctioneer, judicial expert/forensic examiner, or price appraiser.
