PROCESS OF ESTABLISHING A BUSINESS LOCATION

- Law on Enterprises No. 59/2020/QH14 dated June 17, 2020;

2. What is a Business Location
Pursuant to Clause 3, Article 44 of the Enterprise Law 2020, a business establishment is defined as the location where the enterprise carries out specific business operations.
3. What are the documents required for notifying the establishment of a business location
According to Clause 5, Article 45 of the Enterprise Law 2020 and Clause 2, Article 30 of Decree No. 168/2025/ND-CP, the dossier for notifying the establishment of a business location includes:

4. Business Location Registration Procedure
- Procedure:
Step 1: Prepare the business location notification dossier;
Step 2: The enterprise submits the dossier to the business registration authority at the provincial level where the business location is situated within 10 days from the date of the decision to establish the business location;
Step 3: The business registration authority reviews the validity of the dossier;
Step 4: The business registration authority updates the business location information in the National Enterprise Registration Database. If requested by the enterprise, the provincial business registration authority will issue a Certificate of Business Location Registration to the enterprise.
In case the dossier is invalid, the business registration authority must notify the enterprise in writing, specifying the required amendments or supplements.
- Competent Authorities:
- The business registration authority under the Department of Finance at the provincial or central-level city will handle enterprise registration for business locations located within the province or central-level city under its management.
- The management board of high-tech parks will handle enterprise registration for business locations situated within high-tech parks.
- Processing time: 03 working days from the date of receipt of a valid dossier.
